Please ensure that you have read and understood these Terms and Conditions prior to starting a membership with us. We may, at our discretion, review these conditions at any point. In the event of this happening members will be notified via email with 14 day’s notice.

MEMBERSHIP

Payment:

The membership will commence once the payment has been accepted by UP and we have registered you on our system, we will notify you by email of registration.

Payment will be taken via Stripe recurring payments monthly and the member agrees to UP taking payment without prior notice.

Membership fees may be increased at UP’s discretion. Members shall be given at least 21 working days’ notice of any increase in Membership fees.

Any Member who does not wish to accept a change proposed by UP to any Membership fees may cancel his Membership by giving 14 day’s notice to UP in writing (by email). The Member giving notice must continue to pay his Membership fees at the rate current immediately prior to any proposed increase until the end of such notice period.

If the Membership fees are paid by debit or credit card (or any Membership fees remain outstanding beyond the due date) the Member unconditionally and irrevocably authorises UP to debit any credit or debit card provided by the Member with the monthly Membership fee (or any outstanding fees) without prior notice to the Member.

Memberships, once the contract is started, are non-transferable and, save where previously agreed with UP, cannot be shared.

Membership hours

A membership with UP will grant you up to [12/18] hours of studio time per week. If the member is not able to use up the full allowance, the unused hours cannot be carried over.

Opening hours

Opening hours are found on our website.

The studio will close on certain days including Christmas and New Year bank holidays, maintenance days and occasional events. Notice will be given two week’s in advance via email or via UP’s online schedule.

We reserve the right to vary the opening times of the Studio.

Holiday & time in lieu

No holidays or time in lieu are available. If you are going away for an extended period of time we would recommend cancelling your membership and discussing with the Studio manager a possible date to return.

Technicians & help

UP is a work studio for all levels of ability. However, we do ask that you have a basic knowledge of ceramic practice and are happy to work independently.

There is no tuition or teaching included in the membership.

Glaze

Reasonable use of in-house glazes are included within the membership. UP fires to 1240 degrees celsius.

Clay & materials

UP store and reclaim stoneware clay which can be used (Studio Clay). Studio Clay is charged on a per weight basis on the greenware pieces you decide to bisque fire (the “Clay Charge”). The Clay Charge may be increased at UP’s discretion based on pricing from the supplier.

On adding pieces to the bisque fire shelves for first firing, each member must weigh their pieces and add the details to the online “Studio Clay” spreadsheet.

The aggregate weight of fired clay will be calculated on a monthly basis and charged at the end of the month using Stripe payments.

Other clays and materials may be used, but only once discussed with a technician. If other clays are used, the relevant member shall be responsible for their own reclaim and/or disposal.

If other clay is used members can borrow studio plaster batts for reclaim but must not leave clay on these for longer than 24 hours.

Members will need to purchase materials that are not provided but can have deliveries sent to the Studio. UP does not accept any liability for any deliveries.

Kiln Firing Allowance

Work is categorised in two bands; small and large pieces. Anything over 25cm in any direction is considered a large piece.

For small pieces, members have a kiln allowance of 8kg per month (12 hour membership) or 12kg per month (18 hour membership).

For large pieces, please provide volume measurements per piece; height, width and depth.

Kiln allowance for large pieces is worked on on volume. Members have an allowance of 42 litres (12 hour membership) or 63 litres per month (18 hour membership).

If a member goes above their kiln firing allowance, additional charges apply. £2 per kilo for small pieces or 40p per litre for large pieces

If you refire work please provide volume measurements per piece and the refire will be charged at 40p per litre.

SHARING THE STUDIO/STUDIO BEHAVIOUR

Personal and communal storage:

Each member will receive one shelf of personal storage area of 89cm x 44cm x 40cm in the downstairs storage room. Anything stored here must be cleared at the end of the membership.

“Work in progress” shelves in the main studio are shared by all members. Please be mindful of this and use no more than 140cm of communal shelves i.e. two shelves at any given time (12 hour membership). Or 210cm of communal shelves i.e. 3 shelves (18 hour membership).

Items left on the work in progress shelves will be covered the next day if a label with date and name is left with the work. If left with no label, items will be left uncovered.

Work in progress must be labeled and should not be left for more than 3 weeks – unlabelled work in progress which is more than 3 weeks old is at risk of being reclaimed by UP.

Members are responsible for covering own work and cleaning throwing batts and boards after use.

Booking sessions

UP will provide each new member with access to the UP online schedule upon commencement of membership. Each member must add their name to the online schedule for the dates and times they wish to attend the Studio and insert a “(w)” after their name if they need to use the wheel. There is a maximum of 8 wheel users and 4 non wheel users allowed in the Studio at any given time.

UP reserves the right to deny entry to a member who has not signed up to the online schedule or to require a member to leave the session if their presence would be a breach of UP’s health and safety requirements.

Tools & equipment

The membership includes the use of communal tools and equipment.

Please do not use sharp metal tools on pottery wheels as they will damage the wheel head.

Firing & commissions

Please allow 2-3 weeks for your work to go through each firing. Large pieces in particular take longer to dry..

Please also let us know if you are working on a commission and have deadlines. UP will endeavour to accommodate these but makes no guarantee that it can meet any such deadlines.

Items coming out of the bisque firing will be stamped with the date and put on the shelves, where they can stay for up to four weeks. Any items older than four weeks will be moved to the purge shelf downstairs, where they can stay for three weeks. Pieces on the purge shelf older than 3 weeks will be thrown away. If you would like to glaze work at a later stage please store on your personal shelf.

Visitors

Guests are allowed to visit the Studio. Please notify us of this in advance for health and safety purposes.

Guests are not allowed to use the equipment or produce work.

GENERAL HEALTH AND SAFETY

It is of utmost importance that members are aware of the health and safety risks involved in a pottery, and that they work in accordance with these rules to minimise any risks. Some of the hazards involved include but are not limited to; toxic materials, high temperatures, sharp tools, inhalation of silica dust, heavy objects.

The main risk in a pottery studio is silica dust. The dust can be either from dry clay, or from dry glaze powders. To minimise this risk and for the safety of yourself and of others in the Studio, members must:

ensure that they keep all surfaces clean of clay and glaze;

keep communal spaces such as the wedging bench and the sinks, clean and tidy at all times. These are high use, shared resources which members should endeavour to leave in the condition they would like to find them.

after each session they must clean the floor around their workstation to prevent any dust settling;

allow 20 minutes at the end of each session to ensure that you are leaving the workspace you have used clean.

Food and drink is only permitted in the Studio at the designated break-out area.

Please do not enter the kiln area. Kilns will cause a serious burn if touched when hot.

Members must at all times observe the Health & Safety guidelines above which may be notified to them from time to time and are requested to comply with any reasonable directions which the management of the Studio may issue to ensure the smooth operation of the Studio for the convenience of all Members.

TECHNICAL ISSUES

Due to the nature of working with clay, UP cannot be held responsible for any work that gets damaged. Although we will always work our hardest to ensure your pieces are safe, it is inevitable that in a community studio there will be occasional breakages.

We work with experienced and highly trained staff who will handle and fire your work, however there is always a risk of breakages in the process of firing ceramics and therefore the Studio and technicians cannot be held responsible for this.

DATA PROTECTION

By joining our membership, you are consenting to us having your personal data. Please see UP’s privacy policy on our website.

No refunds available.

NOTICE PERIOD/TERMINATION

When terminating a membership you must provide 14 days’ written notice prior to your next renewal date.

UP reserves the right to expel from the Studio (and terminate their Membership of the Studio), suspend their Membership for a specific period or refuse to renew the Membership of any Member:

whose conduct is or may, in UP’s reasonable opinion, be injurious to the character of the Studio; or

who breaches any of these Terms and Conditions (as amended from time to time); or

where, in the absolute discretion of the Studio, it would otherwise be in the best interests of the other Members of the Studio.

Any Member who is expelled by reason of breaching these Terms and Conditions shall immediately cease to be a Member of the Studio and shall not be entitled to any refund in respect of periods in relation to which he has already made payment. Any Member whose Membership is suspended shall not be entitled to any refund in respect of such period. Notwithstanding the foregoing, the Studio may terminate the Membership of any Member in the event that such Member fails to make payment of any sum due to the Studio within 14 days of the date such sum is due. In the event of termination by reason of non-payment, the balance of fees due for the remaining term of the Membership shall become immediately due and payable.

Termination of these Terms and Conditions shall be without prejudice to any rights and obligations of the Studio and Member accrued and owed prior to the date of such termination.

LIMITATION OF LIABILITY

Nothing in these Terms and Conditions shall limit or exclude UP’s liability for:

death or personal injury caused by its negligence, or the negligence of its employees, agents or subcontractors; fraud or fraudulent misrepresentation;

breach of the terms implied by section 2 of the Supply of Goods and Services Act 1982 (title and quiet possession);

breach of the terms implied by section 12 of the Sale of Goods Act 1979 (title and quiet possession); or defective products under the Consumer Protection Act 1987.

Subject to condition 8.1:

UP shall under no circumstances whatsoever be liable to any Member, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, for any loss of profit, or any indirect or consequential loss arising under or in connection with his Membership and/or these Terms and Conditions; and

UP’s total liability to the Member in respect of all other losses arising under or in connection with his Membership and/or these Terms and Conditions and, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, shall in no circumstances exceed the amount of any fees paid by the Member. The terms implied by sections 13 to 15 of the Sale of Goods Act 1979 and the terms implied by sections 3 to 5 of the Supply of Goods and Services Act 1982 are, to the fullest extent permitted by law, excluded from these Terms and Conditions.

General

These terms and conditions are governed by English Law.

We may terminate this agreement with immediate effect on notifying you if you are in breach of these terms.

To the best of your knowledge and belief you are in good health and not knowingly incapable of engaging in either active or passive exercise and that such exercise would not be detrimental to your health, safety, comfort, wellbeing or physical condition. Further, that you will advise us immediately should your circumstances change.

Each Member represents and warrants to UP that all information provided by him is true complete and accurate at the date it is given to UP. Each Member is required to give notice to UP of any change of home address or email address. Failing such notice, all communications will be assumed to have been received by the Member within five days of mailing to the last address notified to UP.

A person who is not a Member has no rights under the Contracts (Rights of Third Parties) Act 1999 to rely upon or enforce any term of these Terms and Conditions.

UP may communicate with the Member by electronic mail (“email”). By providing an email address to UP the Member consents to receiving email communications from UP, including notices pursuant to the Terms and Conditions. The Member also accepts the risk that email may not be a secure and confidential means of communication. UP will not be liable for any loss or damage suffered as a result of communicating with a Member by email.

Any marketing, educational or other materials of this nature whatsoever produced by UP in connection with the Studio and which are made available to Members at the Studio shall at all times remain the property of UP and will be subject to UP’s copyright.

Personal belongings are brought onto the Studio premises at the Member’s own risk and UP does not accept liability for any loss or damage whatsoever to such items.

A person who is not a Member has no rights under the Contracts (Rights of Third Parties) Act 1999 to rely upon or enforce any term of these Terms and Conditions.
